DISPUTES

Any dispute relating in any way to your visit to Health Essential Care or to products you purchase through Health Essential Care shall be submitted to confidential arbitration in Florida, United States, except that, to the extent you have in any manner violated or threatened to violate Health Essential Cares intellectual property rights, Health Essential Care may seek injunctive or other appropriate relief in any state or federal court in the state of Florida, United States, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

This discount card program contains a 30 day cancellation period. The plan provides discounts of 15% - 50% off only at participating providers and payment must be made at the time of purchase. You will receive a full refund of membership fees, excluding registration fee, if membership is canceled within the first 30 days after the effective date. You will receive your new identification card in the mail within 7 to 10 days after purchasing. Recurring charges are billed monthly on your membership effective date.

Disclosures: The Health Essential Care plan is NOT insurance, a health insurance policy or a Medicare Prescription Drug Plan. The plan provides discounts for certain medical services, pharmaceutical supplies, prescription drugs or medical equipment and supplies offered by providers who have agreed to participate in the Plan. The range of discounts for medical, pharmacy or ancillary services offered under the Plan will vary depending on the type of provider and products or services received. The Plan does not make and is prohibited from making members’ payments to providers for products or services received under the Plan. The member is required and obligated to pay for all discounted prescription drugs, medical and pharmaceutical supplies, services, and equipment received under the Plan, but will receive a discount on certain identified medical, pharmaceutical supplies, prescription drugs, medical equipment and supplies from providers in the Plan. The Discount Medical Plan/Discount Plan Organization is Protective Marketing Enterprises, Inc., 5005 LBJ Freeway, Suite 1500, Dallas, TX 75244. The Plan will make available before purchase and upon request, a list of program providers and the providers’ city, state, and specialty, located in the member’s service area. The fees for the plan are specified in the membership agreement. You may cancel The Plan at any time. The plan includes a 30-day cancellation provision.
